CONTRACT

CONTRACT

I am one out of the three engineers in my company who will give a presentation to the rest of the staff on “Engineering, Procurement & Construction Contract.” The motive of the presentation is to educate the young and fresh engineers here the importance and the story relating to contract. With only 2 days more for our presentation, I myself am wondering whether I am really fit to present this topic or not, as I as an engineer is for certain, not a master when it comes to contracts and other legal stuff. So, what have I learnt so far since preparing for the presentation?

A contract –by right- is an agreement binding two or more parties, which each party involved should fulfill what is agreed upon both parties as stated in the contract. Therefore, there will be obligations for each party to enhance in order to fulfill the main objective which is stipulated in the contract.

Dear brothers,
Did you ever realize that we human beings are in fact involved in these so called contracts, even as we are saying now? Each and every one of us has signed an “agreement” with our Creator even before we were born!

“Dan (ingatlah), ketika Tuhanmu mengeluarkan keturunan anak-anak Adam dari sulbi mereka dan Allah mengambil kesaksian terhadap jiwa mereka (seraya berfirman): "Bukankah Aku ini Tuhanmu?" Mereka menjawab: "Betul (Engkau Tuhan kami), kami menjadi saksi". (Kami lakukan yang demikian itu) agar di hari kiamat kamu tidak mengatakan: "Sesungguhnya kami (bani Adam) adalah orang-orang yang lengah terhadap ini (keesaan Tuhan)"
(Surah al-A’raf [7]:172)

Therefore, it is our duty to fulfill the obligations written in the “contract” by obeying His orders and preventing ourselves from misleading to his prohibits, and therefore obtain a happy and worthy life.

Among the obligations which we’ve agreed upon with our Lord are as follow:

“Dan Aku tidak menciptakan jin dan manusia melainkan supaya mereka menyembah-Ku”
(Surah adz-Dzariat [51]:56)

Ingatlah ketika Tuhanmu berfirman kepada para malaikat: "Sesungguhnya Aku hendak menjadikan seorang khalifah di muka bumi". …”
(Surah al-Baqarah [2]:30)

“Dan hendaklah ada di antara kamu segolongan umat yang menyeru kepada kebajikan, menyuruh kepada yang makruf dan mencegah dari yang munkar; merekalah orang-orang yang beruntung.”
(Surah ali Imran [3]:104)

Now, my dear brothers, have we fulfill all our obligations and furthermore receive “Performance Bond” in the likes of Heaven, or are we going to get “Liquated damages” for opposing what is forbidden to us as stated in the “contract”? Think wisely and may this coming Ramadhan bring us back to “fitrah” as stipulated in the Quran and Sunnah.
